Two senior police officers charged with sexual assault
August 5, 2020

Two senior police officers have been charged with aggravated sexual assault and producing child abuse material.

Strike Force Bensbach was established in June following reports of misconduct.

At 5.20am on Wednesday, three search warrants were executed in Sydney’s west. During the search, police seized a number of items.

The senior constables, who are attached to Bankstown Police Transport Command, were arrested and taken to Hurstville police station.

Angelo Dellosa, 30, was charged with inciting aggravated sexual assault, attempted aggravated sexual assault in company and producing child abuse material.

James Delinicolis, 29, was charged with attempted aggravated sexual assault in company, producing child abuse material, and misconduct in public office.

Nine News reported the alleged sexual assault incident involved a high-school student.

Both men were refused bail and were due to appear at Sutherland Local Court on Wednesday.

They have been suspended without pay and investigations continue.

The Law Enforcement Conduct Commission has been briefed.

NSW Police Officers Charged with Sexually Assaulting and Filming Schoolgirl

They take an oath to uphold the law and protect the community; a community that pays over $3 billion every year in New South Wales alone for their service.

But, there are dozens of examples of police officers who have committed serious criminal offences, using their trusted position to assist in the perpetration of crimes.

This is alleged to be the case with two Sydney police officers, who have been arrested and charged with sexual offences against a 17-year old schoolgirl.

30-year old Angelo Dellosa, a married father of two, has been charged with inciting an aggravated sexual assault, attempted aggravated sexual assault in company and producing child abuse material, while 29-year old James Delinicolis is charged with attempted aggravated sexual assault in company, producing child abuse material and misconduct in public office.

The pair have been suspended from the NSW Police Force, and were refused bail in Sutherland Local Court.

They are currently in remand at Silverwater Metropolitan Remand and Reception Centre (the MRRC) until their next court appearance in September 2020.

Court documents allege that James Delinicolis used his position and authority as a New South Wales police officer to prey on the 17-year-old during the course of his duties, for the purposes of “procuring a sexual relationship”, before attempting to have sexual intercourse with the girl in the company of his co-accused.

It is further alleged that the men filmed sexual acts involving the girl.

Professional Standards – the internal team responsible for investigating misconduct by their colleagues – arrested the men, and it’s understood that the police watchdog, the Law Enforcement Conduct Commission (LECC), has also been briefed on the situation.

Police have also indicated that further charges against the men have not been ruled out.

The pair were arrested after a series of raids across Sydney in the early hours of Wednesday and were later charged with a string of offences.

Officer charged - Northern Region

A police officer has been charged with possession of child abuse material.

Following an investigation by the Professional Standards Command (PSC), detectives executed two search warrants in the Coffs Harbour region today (Thursday 27 August 2020).

Investigators seized a mobile phone, smart watch and other electronic and storage devices, which will undergo forensic examination.

The 42-year-old constable, attached to a command in the Northern region, was taken to Coffs Harbour Police Station where he was charged with two counts of possess child abuse material.

He was granted conditional bail and is due to appear in Coffs Harbour Local Court on Monday 28 September 2020.

The officer has been suspended.

Officer charged - Central Metropolitan Region

A serving police officer has been charged following an investigation into an alleged assault.

An investigation was commenced after a 29-year-old constable allegedly assaulted a 40-year-old man while he was being arrested in Zetland on 30 January 2020 on an outstanding warrant.

Following inquiries, the officer – who is attached to a command within the Central Metropolitan Region – was issued a Future Court Attendance Notice today (Wednesday 26 August 2020), for the offences of assault occasioning actual bodily harm, and common assault.

He is due to appear in Downing Centre Local Court on Wednesday 7 October 2020.

Officer charged with traffic offences - Specialist Command

A police officer has been charged with traffic offences allegedly committed while on-duty earlier this year.

Officers from the Traffic and Highway Patrol Command commenced an investigation into the actions of the officer following a pursuit on the M1 near the Queensland-New South Wales border on Saturday 14 March 2020.

Following inquiries, the 46-year-old man, who is a sergeant attached to a Specialist Command, was issued a Court Attendance Notice yesterday (Tuesday 25 August 2020) for driving at a speed/manner dangerous, negligent driving and Class A motor vehicle exceed speed over 45km/h.

He is due to appear at Byron Bay Local Court on Monday 12 October 2020.

The officer’s licence has been suspended.

In the United States in the late 2010s there has been a increase in the number of police brutality cases. The number of deaths caused by a police officer has increased from 397 to 426 deaths in 2013.[317]

In a study done by the Research Triangle Institute in 2015, arrest-related deaths were ranked higher than supplementary homicide reports in US deaths by approximately 4%.[citation needed]

A study conducted by the police violence tracking website fatalencounters.org showed the records of over 26,000 people killed by police across the US since 2000, at an average of over 1300 people per year until 2019.[318] In 2016, police killed 574 White Americans, 266 African Americans, 183 Hispanics, 24 Native Americans, and 21 Asians. However, for every million in population, police killed 10.13 Native Americans, 6.66 African Americans, 3.23 Hispanics, 2.9 White Americans, and 1.17 Asians.[319]

In 2017, there were 1,147 deaths accounted for by police, of which in 13 cases police officers were charged with a crime. 640 of the deaths caused by police officers that year were responses to non-violent offenses and no crime was reported. 149 people killed by the police were unarmed.[320]

A study done by mappingpoliceviolence.org shows that in 2019 there was only 27 days where police in the United States didn't kill someone. It also showed black people are three times more likely to be killed than white people.[321]

Twenty years later and still no compensation payment, no charges against the police officers and two of them are still in the job. Even after a International Human Rights decision, the government is refusing liability for compensation.

This is nothing 'new'. It haa been going on for decades. With 'extra powers' given to police during covid-1984, it will be no surprise to see a massive increase in police brutality world wide.

It is a known phenomenon that there is a small number of psychopathic minds within any department and if they get through the training program, they will go on to do bad things, it is inbuilt.

NSW police accused of bashing Corey Barker cleared by court

A group of policemen have been found not guilty of charges almost six years after a man was allegedly bashed at a NSW police station.

A sixth police officer has been cleared of charges stemming from the alleged bashing in custody of an Aboriginal man in a northern NSW station almost six years ago.

Supporters in the public gallery said "yes" as Senior Constable David Hill, 36, was on Wednesday cleared of charges, including perjury and trying to pervert the course of justice, after Corey Barker was taken to Ballina police station in January 2011.

His acquittal comes after the Police Integrity Commission (PIC) found the officers had lied about the January 2011 incident, during which they alleged Mr Barker punched Mr Hill in the face.

The other officers, then-Senior Constable Mark Woolven, 45, Constables Ryan Charles Eckersley, 36, and Luke Christopher Mewing, 31, along with Probationary Constable Lee David Walmsley, 26, and Sergeant Robert Campbell McCubben, 49, were found not guilty of their various charges, including assault, on Tuesday.

The District Court jury had been shown CCTV footage that appeared to show Mr Barker being assaulted by officers as he was moved from a dock to a cell.

The footage, which the defence claimed did not show all of the events because it had been recorded on a delayed-capture mode, did not show Mr Barker punching Mr Hill.

Mr Barker was charged with assaulting the officer in 2011 but the case was thrown out.

The PIC later found he had never attempted to punch Mr Hill.

The jury also heard that Mr Hill's statement about the incident, sworn on January 19, 2011, was emailed to some of the other officers to help them prepare their own statements for the court case against Mr Barker.

Each officer's statement, read to the court, said Mr Barker had been yelling abuse and threats, and punching and kicking the walls of the perspex dock where he was initially held.

The statements were backed by CCTV footage showing Mr Barker beating and kicking out at the walls of the holding dock.

Mr Hill's statement said Mr Barker pulled free while being taken by police to the cells and "punched me with a closed right fist to the nose" in a blow that left no physical injury.

The other officers gave similar accounts of what happened.

Mr Hill did not comment as he left the Sydney Downing Centre on Wednesday.

Mr Mewing and Mr McCubben are no longer police officers.

Corruption and Misconduct Still Pervade the NSW Police Force

Former NSW police sergeant Nigel Alfred Davey was found guilty of common assault and perjury in Queanbeyan Local Court on December 12. Magistrate Michael Antrum ruled that Davey lied in court in October 2014, when he said a Nowra man was armed with a knife at the time he tasered him.

On June 14 2013, Davey tasered an unarmed Regan Sutton from five metres away, whilst he was still sitting in his car. By the time of the Nowra hearing against Sutton, Mr Davey was on suspension from the police force, due to an incident on January 26 2014 that also involved a taser.

Mr Davey originally claimed that after he stopped alongside Mr Sutton’s car on Mackay Street in Nowra, Sutton had approached his vehicle and tried to stab him. The ex-cop tasered Sutton a total of three times.

However, under cross-examination, Davey said he couldn’t remember seeing the knife in Sutton’s hand. And nor could he account for his assailant standing five metres away from his car, while at the same time being close enough to threaten to stab him.

Davey had his employment with NSW police terminated in 2015. And he’s set to be sentenced over the Sutton incident on Friday.

The new police watchdog

The investigation into Mr Davey’s conduct was overseen by the Law Enforcement Conduct Commission (LECC), which came into existence on July 1 last year. It was established via a bill that was introduced into NSW state parliament by police minister Troy Grant in September 2016.

The new police oversight body replaced the Police Integrity Commission (PIC), the police division of the Ombudsman’s office and the Inspector of the NSW Crime Commission (NSWCC).

As part of its new role, the LECC produced the Police Integrity Commission Annual Report 2016-17, which was released on December 18. The report lists a total of 17 former and current NSW police officers that were prosecuted over the last two years in part due to PIC/LECC investigations.

Acquitted on misconduct charges

These investigations included the prosecution of four NSW police officers accused of lying about the shooting of mentally ill man Adam Salter in 2009.

The investigation was sparked after a 2011 coronial inquest found that it was likely sergeant Sheree Bissett had mistakenly reached for her gun, rather than her taser, when she shot Mr Salter. But, the officers were found not guilty at the Downing Centre District Court on June 23 2016.

And a total of six NSW police officers were cleared of charges in December 2016 over the alleged bashing of Corey Barker at Ballina police station in early 2011. Four of the officers were accused of assaulting the Aboriginal man, while all six were said to have falsely claimed he’d committed a crime.

The Wood Royal Commission

Last year, marked 20 years, since the Royal Commission into the NSW Police Service delivered its final report. The commission found that NSW police culture had developed a set of values and rules that often contradict “the formal written laws, regulations and guidelines regarding police practice.”

Police culture was shown to be marred by a cynical and pessimistic attitude to the social environment. And it also permitted sexism, a glorification of alcohol, and a prejudice “attitude towards minorities.”

The Wood Royal Commission was held over the years 1995 through to 1997. The investigation focused on the existence and extent of corruption in the NSW police force. And it made recommendations in regard to improving accountability within it.

One of the Royal Commission’s recommendations was to establish a permanent body to investigate police corruption. This led to the PIC being brought into existence via the Police Integrity Commission Act in July 1996.

Recruiting the other side

However, despite efforts to stamp out corruption, criminality continues to be entrenched within the culture of NSW police. A 2014 Fairfax Media report, based on figures obtained via freedom of information laws, found that the force was recruiting hundreds of former criminals.

The report revealed that recently recruited officers had been convicted of 414 offences before entering the force. These included cases of break, enter and steal, fraud, drug and firearms crimes, along with over 100 drink driving offences.

Indeed, one in 40 officers had committed an offence either prior to or after joining NSW police.

A former police officer, Richard McDonald, obtained the figures. He outlined that the number of police with convictions had risen by 250 percent since 2008, while the number of officers in the force had only increased by 6 percent over the same period.


Dozens before the courts

A News Corp report revealed in April 2016 that 32 police officers were currently suspended whilst waiting to go before the courts, and another 21 were still on duty after allegedly having broken the law.

At the time, NSW police officers were facing rape, child sexual assault, drug supply, and stalking or intimidation charges.

Responding to the report, then NSW police commissioner Andrew Scipione said that he was “frustrated and bitterly disappointed” that any officers were betraying their oaths. While police minster Grant denied NSW police had any cultural problems.

Corrupt watchdogs

And early last year, it came to light that dozens of former and current police officers had been subjected to invasive and unwarranted investigations by the NSWCC’s Taskforce Mascot, which was established in 1999, following the Wood Royal Commission.

The taskforce was staffed by former NSW police officers and charged with investigating allegations of corruption in the force. However, an inquiry into Mascot revealed that it was investigating some officers with clean records, as well as others it’s staff had personal differences with.

After complaints were made over the conduct of Taskforce Mascot operations, another internal investigation was established in 2003, codenamed Strike Force Emblems. But, the new body was soon disbanded, as the NSWCC refused to issue affidavits to allow it to secure surveillance warrants.

Police investigating their own

The LECC’s establishment followed recommendations made by former NSW shadow attorney general Andrew Tink in a police oversight report released in August 2015.

However, then acting NSW Ombudsman John McMillan warned in September 2016 that the LECC would have seriously limited powers.

On the day minister Grant introduced the LECC legalisation, NSW Greens MLC David Shoebridge expressed concerns about the new model, as it leaves the oversight body to simply monitor police investigations, rather than actually conducting them itself.

“We have an inherent conflict of interest when police investigate police,” Mr Shoebridge told Sydney Criminal Lawyers® back in August 2016. “It means nobody can have faith in the independence of the investigation.”
